Welcome to Hookt! These Terms of Service ("Terms") govern your access to and use of the Hookt dating application and website (collectively, the "Service"). By creating an account or using our Service, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree to these Terms, you may not use our Service.

1. Eligibility

To use Hookt, you must:

  • Be at least 18 years old
  • Be legally able to enter into a binding contract
  • Not be prohibited from using the Service under applicable laws
  • Not have been previously banned from Hookt
  • Comply with all local, state, and federal laws regarding online conduct

By creating an account, you represent and warrant that you meet all of these requirements.

2. Account Creation and Security

2.1 Account Information

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

2.2 One Account Per Person

You may only create one account. Creating multiple accounts may result in termination of all your accounts.

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms, fraudulent activity, or behavior that we deem harmful to other users or our Service.

3. User Conduct

You agree to use Hookt responsibly and in accordance with our Community Guidelines. You agree NOT to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Impersonate any person or entity, or falsely state or misrepresent yourself
  • Post or share content that is offensive, abusive, defamatory, or harassing
  • Post or share sexually explicit content or nudity
  • Engage in any form of harassment, bullying, or hate speech
  • Solicit money or financial information from other users
  • Use the Service for commercial purposes or advertising without our permission
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated systems (bots) to access or interact with the Service
  • Collect or harvest information about other users without their consent
  • Post spam, scams, or fraudulent content
  • Interfere with or disrupt the Service or servers

4. Content

4.1 Your Content

You retain ownership of all content you post on Hookt, including photos, messages, and profile information ("Your Content"). However, by posting Your Content, you grant Hookt a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display Your Content for the purpose of operating and improving the Service.

4.2 Content Standards

All content you post must:

  • Be accurate and not misleading
  • Comply with all applicable laws
  • Not infringe on anyone's intellectual property rights
  • Not contain viruses or malicious code
  • Be appropriate for a general audience

4.3 Content Moderation

We reserve the right to review, monitor, and remove any content that violates these Terms or our Community Guidelines. However, we are not obligated to monitor all content and are not responsible for content posted by users.

4.4 Copyright

5. Location Tracking

Hookt offers optional live location tracking features. By using these features, you acknowledge and agree that:

  • Location tracking is entirely optional and under your control
  • You can enable or disable location tracking at any time
  • When enabled, your real-time location will be shared with people you choose via a unique link
  • You are responsible for deciding who to share your location with
  • Hookt is not responsible for how recipients use your location information
  • Location data is transmitted securely but may be subject to technical limitations

6. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using Hookt, you also agree to our Privacy Policy, which is incorporated into these Terms by reference.

  • We encrypt your messages end-to-end
  • We never sell your personal data to third parties
  • You can delete your account and data at any time
  • We use your data to improve the Service and provide personalized matches

7. Safety and Interactions

7.1 Meeting in Person

Hookt facilitates online connections, but we cannot control what happens when users meet in person. You acknowledge that:

  • Hookt does not conduct background checks on users
  • You are solely responsible for your interactions with other users
  • You should follow safety guidelines when meeting people from the app
  • Hookt is not responsible for the conduct of users on or off the Service

7.2 Safety Features

While we provide safety features like location tracking and emergency contacts, these are tools to assist you. They do not guarantee your safety, and you should always exercise caution and good judgment.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Hookt disclaims all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • That the Service will be uninterrupted, secure, or error-free
  • That defects will be corrected
  • That the Service is free of viruses or harmful components
  • The accuracy, reliability, or completeness of any content on the Service

We do not guarantee that you will find a match or that any matches will be compatible with you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOOKT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

This includes but is not limited to damages resulting from:

  • Your use or inability to use the Service
  • Unauthorized access to your account or data
  • Conduct of other users on or off the Service
  • Any content obtained from the Service

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Hookt and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you post on the Service
  • Your interactions with other users

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

11.2 Arbitration

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.

11.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and Hookt individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Modifications to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically to stay informed of any changes.

13. Termination

You may terminate your account at any time by going to Settings and selecting "Delete Account." Upon termination:

  • Your profile will be removed from the Service
  • Your matches and messages will be deleted
  • Your personal data will be permanently deleted within 30 days
  • Some information may be retained as required by law or for legitimate business purposes

We may terminate or suspend your account immediately, without prior notice, for any reason, including violation of these Terms.

14. General Provisions

14.1 Entire Agreement

These Terms, along with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Hookt regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

14.5 Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party sites.
